1. Definitions

“Medsol” refers to Medsol Ltd., a company registered under UIC 205390677, with its registered office and business address at 13 Sveta Gora Str., Floor 1, 1164 Sofia, Bulgaria. Contact details: telephone +359876045534, email: sales@cpapeuropa.com, website: www.cpapeuropa.com.

“Terms” or “General Terms and Conditions” means these Terms and Conditions governing the use of the website and the purchase of goods and/or services through the online store.

“Online Store” refers to the electronic commerce platform operated by Medsol and accessible at www.cpapeuropa.com, through which products and/or services are offered for sale.

“Website” or “Site” means the internet domain www.cpapeuropa.com, including all its pages, content, and functionalities.

“User” or “Consumer” means any natural person who accesses the Website and purchases goods or uses services for purposes outside their trade, business, or professional activity.

“Product” means any good or service made available for purchase through the Online Store.

“Hygiene Products” means Products supplied in sealed packaging which, once opened, cannot be returned due to health protection or hygiene considerations.

“Contract” means any distance contract concluded between Medsol and a User for the purchase of Products through the Online Store, including these Terms and any related documents forming part of the agreement.

“Durable Medium” means any instrument that enables the User or the Company to store information addressed personally to them in a manner accessible for future reference for a period adequate for the purposes of the information, and which allows the unchanged reproduction of the stored information, including but not limited to paper, email, USB devices, CDs, DVDs, memory cards, and computer storage systems.

“Withdrawal Form” means the standard form made available on the Website that allows the User to exercise their right to withdraw from a Contract, where applicable.

“Privacy Policy” means the document published on the Website describing how personal data is collected, processed, and protected.

2. Subject to the General Terms and Conditions

(1) This document sets out the General Terms and Conditions under which Medsol provides products and services to Users through the Online Store. By accessing or using the Site and the Online Store, the User agrees to these Terms and Conditions in full. If you do not agree with any part of them, please do not use the Site.

(2) Medsol reserves the right to update or modify these General Terms and Conditions at any time, in order to reflect changes in the operation of the Online Store or legal requirements. Any changes will take effect once they are published on the Site. The Terms and Conditions applicable to each Contract are those in force at the time the contract is concluded.

(3) If any provision of these Terms and Conditions is found to be invalid or unenforceable, this will not affect the validity of the remaining provisions.

(4) These General Terms and Conditions apply only to contracts concluded through the Online Store. They do not apply to contracts between Medsol and Users made through other sales channels.

3. Personal Data

(1) Medsol processes personal data only as described in these Terms and in accordance with applicable law, unless the User has expressly agreed to another use. In certain cases, Medsol may process and store personal data where required to comply with legal obligations.

(2) Medsol shares personal data only for specific purposes and only with the third parties listed below, unless the User has given additional consent for sharing data with other parties. Medsol takes appropriate measures to ensure that personal data is processed, protected, and transferred in compliance with applicable law.

(3) Where necessary, Medsol may engage third parties to perform certain activities related to its services, such as website maintenance, technical support, and delivery of goods (including postal operators, courier services, and other subcontractors).

(4) Personal data is provided to such third parties only to the extent necessary for the relevant purpose. These parties are not allowed to use the data for any other purpose, including their own or for third parties. All external service providers are required to keep personal data confidential.

(5) Additional information about how Medsol processes personal data can be found in the Privacy Policy available on the Site.

4. Terms of Ordering Goods

Consent
By clicking the “Order” button, the User submits an electronic declaration confirming that they have read, understood, and fully accepted these Terms and Conditions.

Placing an Order
Orders are placed through the Online Store by selecting a product and completing the required information, including a payment method and contact details. After submitting the order, the User will receive a confirmation that the order has been received.

Order Confirmation
Medsol will confirm or decline the order by phone or email. Medsol reserves the right not to process an order if the provided customer information is incomplete, incorrect, or invalid. In such cases, the User will be notified using the provided contact details.

Orders placed before 15:00 EET on a working day are usually processed on the same day. Orders placed after this time, or on non-working days, are processed on the next business day.

Order confirmation is provided to the User on a durable medium (such as email).

Taxes and VAT
All prices listed on the Site include VAT, unless stated otherwise.

Distance Sales Contract
The contract between Medsol and the User is considered concluded once the User receives confirmation of the order from Medsol.

The contract includes all agreements between the parties, including the order, order confirmation, any related documents, forms, warranty information (if applicable), and these General Terms and Conditions.

5. Delivery Terms

The delivery time for products in stock ordered through the Online Store is between 1 and 14 working days within the EU, depending on the shipping method chosen, and between 3 and 14 working days for countries outside the EU. 

Medsol offers free shipping on all orders over 150 EUR within the EU. For orders below this amount, as well as for all orders shipped outside the EU, delivery costs are calculated based on the tariffs of courier companies such as DHL, PostOne or other courier services used.

In the event of a delivery delay, regardless of the reason, Medsol will inform the User and provide an updated delivery timeframe.

For orders placed from outside the EU, the User is responsible for complying with local customs regulations related to the import of medical equipment. Any applicable duties, taxes, and customs clearance procedures are the responsibility of the User.

If the User refuses delivery or fails to complete customs procedures, the order will be treated as a return and the applicable shipping and return costs may be deducted.

6. Terms and Methods of Payment

Medsol supports most common electronic payment methods within the EU. Available payment options include bank transfer, Visa, MasterCard, American Express, PayPal, Klarna, and Revolut. During the checkout process, the User can select their preferred payment method and will be redirected to the relevant payment page.

For online payments and bank transfers, Medsol is not responsible for any additional fees, commissions, or charges applied by the User’s bank or payment provider. This includes any costs related to currency conversion when the payment is made in a currency different from EUR.

7. Return Policy

(1) The User has the right to return goods purchased from the Online Store without providing a reason, within the period specified below. In such cases, the User will be refunded the full amount paid, excluding shipping charges, in accordance with applicable law. Returns are subject to the following conditions:

– a return request must be submitted through the return form available on the Website or by email to sales@cpapeuropa.com, no later than 30 days from the date the goods were received by the User or a person designated by them. In case of dispute, the date of delivery is determined based on the courier’s delivery confirmation.

– the goods must be in their original condition, without signs of use, and in good commercial appearance. They must be returned in their original packaging, with all original labels attached, and accompanied by all documents provided by Medsol, including invoice (if issued), receipt, and any other documents supplied at the time of delivery.

– all returns must be approved by Medsol in advance. Products sent back without prior confirmation may not be accepted or refunded.

– for hygiene and health protection reasons, products that come into contact with the body (including CPAP masks and related accessories) cannot be returned once opened or used.

(2) The User must send or return the goods to Medsol without unnecessary delay and no later than 14 days from the date the return request was submitted.

(3) The User is responsible for any reduced value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and proper functioning.

(4) The User is responsible for all direct costs related to returning the goods, including courier charges, based on the tariffs of the selected courier service.

(5) The right of withdrawal and return does not apply in the following cases:

– products made to order or customized according to the User’s individual requirements;
– sterile, hygiene, or consumable products that are factory-sealed and have been opened after delivery, including but not limited to CPAP masks and mask parts.

(6) Medsol reserves the right to refuse a refund if one or more of the return conditions are not met.

(7) Medsol will refund all amounts received from the User within 14 days from the date the User notifies Medsol of the withdrawal, but not before the goods are returned or proof of return is provided. 

(8) Medsol is not required to refund any additional delivery costs if the User has chosen a delivery method other than the standard and most economical option offered.

(9) Original delivery costs are non-refundable. If the order qualified for free shipping, Medsol reserves the right to deduct the actual shipping cost from the refund amount.

(10) If an order is refused, not collected, cannot be delivered due to customer-related reasons (including failure to complete customs procedures), or is cancelled after dispatch but before delivery, it will be treated as a return. In such cases, all applicable shipping, return, handling, and any customs-related costs may be deducted from the refund.

(11) For orders delivered outside the European Union, Medsol reserves the right to refuse returns or refunds, particularly where additional costs, customs restrictions, or logistical limitations prevent the proper processing of the return.

8. Complaints, Objections and Recommendations

(1) The User has the right to submit complaints, objections, or recommendations to Medsol by email at sales@cpapeuropa.com.

(2) The request must include the name of the person submitting it, their contact details, a description of the issue or concern, and what the request relates to. Anonymous requests will not be considered.

(3) Medsol will review all requests within one month of receipt and will respond in writing by email.

9. Warranties and Post-Warranty Service

(1) The User has the right to report any lack of conformity of the received Product with the sales contract and to request that Medsol brings the Product into compliance.

(2) This right may be exercised within 2 (two) years from the date of delivery of the Product.

(3) Medsol is not responsible for defects caused by improper use, use contrary to the provided instructions, or external factors.

(4) Warranty claims must be submitted by email at sales@cpapeuropa.com. The User is responsible for the cost of sending the Product to Medsol. If the claim is accepted, Medsol will cover the cost of returning the Product. If the claim is rejected, Medsol reserves the right to charge the User for the return shipping.

10. Content and Copyrighted Material

(1) All content available on the Site is the property of Medsol and is protected by copyright.

(2) The content is provided for informational purposes only and does not replace professional medical advice.

(3) Users should always consult a qualified healthcare professional.

(4) Any reliance on information provided on the Site is at the User’s own risk.

11. Linking Policy

Medsol welcomes links to its homepage, blog posts, and product pages.

(1) Links must be text-based and must not use the CPAPEUROPA logo.

(2) Links must not imply sponsorship or endorsement by Medsol.

12. Force Majeure

Medsol shall not be liable for delays or failure to perform obligations due to events beyond its reasonable control, including but not limited to natural disasters, strikes, wars, government measures, or disruptions in transport, logistics, or supply chains.

13. Governing Law

These Terms and Conditions are governed by the laws of Bulgaria. Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the competent courts in Bulgaria.
